Pre-Filing Advisory

The Nice Classification, established by the Nice Agreement (1957), represents a standardized international system for the classification of goods and services for the purposes of trademark registration. Administered by the World Intellectual Property Organization (WIPO), the Nice Classification is adopted by most intellectual property offices worldwide, including the Romanian State Office for Inventions and Trademarks (OSIM) and the European Union Intellectual Property Office (EUIPO).

This classification system is structured into 45 distinct classes—34 for goods and 11 for services—each encompassing specific categories relevant to economic and commercial activities. Proper selection and accurate specification of the relevant classes within a trademark application are essential for defining the scope of legal protection and preventing potential objections or invalidation risks.

Our trademark attorneys provide strategic guidance in aligning the client’s commercial objectives with the appropriate classes under the NCL. We ensure that the goods and services are precisely drafted in accordance with WIPO’s official alphabetical list and harmonized practice. Additionally, we assess potential overlaps with prior rights and recommend optimal class coverage to support future enforcement and licensing activities.
