Intellectual Property as a Strategic Asset for Deep Tech Start-ups
For deep tech companies, intellectual property is rarely just a legal asset. It influences investment decisions, technology transfer, market access and, ultimately, the ability to scale internationally. While founders often associate IP primarily with patents, long-term commercial success depends on a broader set of strategic considerations, including ownership of innovation, freedom to operate, licensing structures and the protection of confidential know-how.
Unlike many technology businesses, deep tech companies build their competitive advantage on years of research and development. Their value is intrinsically linked to intangible assets that must not only be protected, but also managed in a way that supports commercialisation and future growth. A strong intellectual property strategy therefore becomes an essential part of business strategy rather than a legal exercise undertaken at a later stage.

In practice, many of the most significant IP decisions are made long before a company enters new markets or raises institutional investment. Questions surrounding inventorship, ownership of research results, patent filing strategies, software protection, licensing or collaboration with research organisations can have lasting implications for a company’s ability to attract investment and commercialise its technology.
Recognising that access to capital alone is not sufficient to support high-growth innovation, European programmes increasingly combine financial assistance with specialist coaching and mentoring. Their objective is to provide founders with the strategic expertise required to navigate the legal and commercial challenges that accompany the development of deep tech businesses.
One such initiative is EPIC-X (Excelling deep tech through place-based Innovation and Connected Ecosystems), a Horizon Europe programme supporting women-led deep tech start-ups across Europe’s widening innovation ecosystems. By bringing together entrepreneurs, investors and subject-matter experts, the programme helps participating companies strengthen their business models and prepare for sustainable growth.
Within this framework, intellectual property plays a central role. A well-structured IP strategy can enhance investment readiness, facilitate strategic partnerships, reduce legal risk and support international expansion. Equally important, it provides founders with a clearer understanding of how intellectual property contributes to the long-term value of their business.
Irimia & Partners participates in the EPIC-X programme as an IP Coach, providing strategic guidance to participating companies on the protection, management and commercialisation of intellectual property. Our work focuses on practical issues that arise throughout the growth journey of deep tech businesses, including patent strategy, ownership of innovation, freedom to operate, licensing, trade mark protection and the management of intangible assets.
As European deep tech companies continue to scale, intellectual property will remain a defining factor in their ability to compete globally. Integrating IP strategy into business decision-making from the earliest stages is no longer simply a matter of legal protection; it is a prerequisite for sustainable growth, investment readiness and successful commercialisation.
